PETALING JAYA, May 29 — A Sessions Court judge has recused herself from hearing the case of Parti Keadilan Rakyat (PKR) communication director Nik Nazmi Nik Ahmad, who is charged with the organising of a rally at the MBPJ Kelana Jaya Stadium as the accused is related to her family.

Judge Rozina Ayob, who was supposed to hear the case today, made the decision after being informed by her father that she and Nik Nazmi (picture) were relatives.

As such, she requested the case to be transferred to another Sessions Court.< br/>

“To be fair to all parties, I recuse myself from hearing this case and transfer the case to Sessions Court 1,” she added.

Meanwhile, judge Hayatul Akmal Abdul Aziz, who then heard the case, set August 26 for mention.

Deputy public prosecutor Wan Shaharuddin Wan Ladin, who prosecuted, also informed the court that the documents for the hearing had been handed over to the defence.

Nik Nazmi, 31, as the organiser of the rally, is charged with failing to notify the Petaling Jaya police about the venue of the ‘Blackout 505’ rally within the stipulated period, which is 10 days, before the date of the assembly.

The Seri Setia Assemblyman is alleged to have committed the offence at the Petaling Jaya City Council Stadium (MBPJ) in Kelana Jaya here at 8.30pm last May 8.

Nik Nazmi, represented by lawyers Shah Redzan Johan and Adi Mohd Noor, is charged under Section 9 (1) of the Peaceful Assembly Act 2012 which carries a fine of not more than RM10,000, if found guilty. — Bernama
